TERMS AND CONDITIONS OF SERVICE – FITMUSIC

These Terms and Conditions govern your access to, use of, and purchase of products and services offered by FitMusic ("we", "us", "our", "the platform").
By accessing the website or making a purchase, the user accepts these Terms and Conditions in full.
1. Description of the service
FitMusic is a platform dedicated to the sale of professional digital music for Indoor Cycling classes, including:
1. 50-minute album-tracks
2. Individual Topics
3. Custom Album-Track Creation Services
All the products offered are digital. No physical shipments are made.
2. Professional use
FitMusic products are intended exclusively for professional use by instructors, trainers or Indoor Cycling studios.
Use of the products is subject to the Music License, which forms an integral part of these Terms and Conditions.
3. User Account
To make a purchase, the user may provide personal and contact information.
The user is responsible for:
1. Keeping your account confidential
2. Provide truthful and up-to-date information
3. All activities performed from your account
4. Pricing and Payments
Prices for products and services are listed in the store and may be expressed in U.S. dollars (USD) or other currency depending on settings.
FitMusic reserves the right to change prices at any time. The changes will not affect purchases already made.
Payments are processed through secure third-party providers.
5. Digital Product Delivery
Once payment is confirmed:
1. The user will get access to the purchased digital product
2. Access can be by download or direct access on the platform
FitMusic is not responsible for access problems arising from:
1. User device failures
2. Internet connection
3. Incorrect use of the product

4. Digital products purchased from FitMusic allow a limited number of downloads.
5. Each product may be downloaded up to a maximum of three (3) times.
6. Once this limit is reached, access to new downloads will be disabled.
7. It is the user's responsibility to store and safeguard downloaded files correctly.
6. Refunds and cancellations
Due to the digital nature of the products:
1. All sales are final
2. No refunds, changes or cancellations are made
3. This includes individual products, album-tracks and personalized services.
7. Personalized services
For custom Album-Tracks services:
1. The client provides instructions, texts or base music.
2. FitMusic performs the mixing work as agreed.
3. The final result is subject to the License of Use.
Once the work is delivered, no returns or refunds are accepted.
8. Intellectual Property
All content available on FitMusic, including music, mixes, text, and design, is the intellectual property of FitMusic or has the rights to it.
The purchase of a product does not transfer ownership, it only grants a right of use under the Music Use License.
9. Misuse
It is prohibited:
1. Resell or redistribute the products.
2. Share digital files.
3. Upload content to public platforms.
4. Claim copyright in the acquired material.
FitMusic reserves the right to suspend access and take legal action in the event of misuse.
10. Limitation of Liability
FitMusic will not be responsible for:
1. Indirect or consequential losses.
2. Service interruptions.
3. Misuse of the products by the user.
The use of the products is the sole responsibility of the user.
11. Modifications
FitMusic may modify these Terms and Conditions at any time. Modifications will be effective upon posting on the website.
12. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Colombia.
