FITMUSIC – MUSIC USE LICENSE

This Music Use License ("License") applies to all digital products and personalized services purchased from FitMusic ("we", "us", "our", "the brand").

By purchasing, downloading, or using any FitMusic product, you agree to the terms described below.

 

1. Nature of the products

All products sold by FitMusic are digital audio products. No physical shipments are made.

Products include:

1.                   50-minute album-tracks for Indoor Cycling

2.                   Individual tracks included in these albums

3.                   Custom Mix Creation Services for Indoor Cycling

Access to digital products is granted once payment is confirmed.

 

2. License Grant

By purchasing a FitMusic product, the purchaser is granted a non-exclusive, non-transferable, non-sublicensable license to use the music solely in Indoor Cycling classes.

This license allows:

1.                   Use music in face-to-face or online Indoor Cycling classes

2.                   Using music as part of the instructor's professional activity

3.                   Play music in free or paid classes

This license does not transfer ownership of the music.

 

3. Restrictions

The user may NOT:

1.                   Resell, redistribute, share, or give away audio files

2.                   Upload music to streaming platforms (Spotify, Apple Music, SoundCloud, etc.)

3.                   Uploading music to public video platforms or social media (YouTube, Vimeo, Instagram, TikTok, etc.)

4.                   Claiming authorship of music or mixes

5.                   Register music with copyright or Content ID systems

6.                   Modify, remix, or create derivative works for redistribution

7.                   Using music outside the context of Indoor Cycling classes

Each purchase is intended for the use of a single instructor or a single studio, unless previously agreed to in writing with FitMusic.

 

4. Intellectual Property

All music, mixes, and audio content are  the exclusive intellectual property of FitMusic.

The purchase of a product grants only a right of use, not ownership of the musical work or its components.

 

5. Personalized Album-Track Services

In the case of custom blends:

1.                   FitMusic retains authorship and all intellectual property rights

2.                   The customer receives the same license to use described herein

3.                   The customer may not resell, redistribute or claim authorship of the submitted material

The provision of music, playlists or instructions by the customer does not imply the transfer of rights to the final mix.

 

6. Refunds and returns

Due to the digital nature of the products:

1.                   All sales are final

2.                   No refunds or exchanges are made once the content has been delivered or downloaded

 

7. Termination of License

FitMusic reserves the right to revoke this license immediately if any of the terms set forth herein are breached.

Unauthorized use may result in:

1.                   Cancellation of the right of use

2.                   Legal action where applicable

 

8. Applicable legislation

This License is governed by the laws of the Republic of Colombia, without regard to conflict of law rules.
